'Sunjay Kapur' the Karisma Kapoor's husband goes to court

It's now official. Another Bollywood marriage is on the rocks.
Marital differences between actor Karisma Kapoor and her husband Sunjay Kapur had been reported earlier, but on Friday Sunjay moved court, seeking to prevent Karisma from taking their five-month-old daughter Samaira out of the country without his consent.

Sunjay Kapur, the son of Sona Steering promoter Surinder Kapur, filed his petition before the Delhi high court.

Justice Mukul Mudgal accepted the plea and passed a restraining order, directing Karisma not to take her daughter abroad without her husband's approval.

Notice was also issued to Karisma, the regional passport office in Mumbai and the ministry of external affairs.Although the issue is now limited to Samaira's overseas travel, people close to the Kapur family said this could soon develop into a battle for custody of the child. They claimed the marriage had probably soured beyond repair.

The high court has directed all the respondents—Karisma, the RPO, Mumbai and theMEA—to reply by August 12. Sunjay has been directed to serve the notice on Karisma himself.

This is possibly because the marriage has not been formally anulled.

Senior advocate Indira Jaisingh filed the petition under Article 226 on behalf of Sunjay Kapur. She argued before Justice Mudgal that the passport office had issued the document in Samaira's name illegally. "My client and his wife continue to be married.

He is also the natural guardian of the child and has the right to decide when, how and for what purpose the child must travel abroad," Jaisingh said.

She claimed her client was never informed about the passport, while the law clearly states that for a minor child both parents have to submit an affidavit.

According to her, Sunjay learnt about the passport last month. Since it had been issued by the RPO, Mumbai, Sunjay wrote to the authority protesting against issue of the passport.

He later requested the MEA to investigate the matter. Sunjay apprehends that Karisma intends taking Samaira to the UK and the US. Sunjay claimed that if a couple was divorced, a separate form had to be filled declaring the same.

And if the husband and wife are estranged, the passport office needs to be informed, so that it can get in touch with both parents. Sunjay alleged the RPO prepared the passport in collusion with his wife, Karisma, without following legal procedure.
